Last Will & Testament of Barbara Shiels

19th day of November 1929

I, Miss Barbara Shiels residing at Eastmains, Coulter, Lanarkshire, in order to settle the succession to my means and estate in the event of my death, do hereby nominate and appoint William Brown Pairman, Agent of the National Bank, Biggar, whom failing by his predeceasing me, William Ewart, Solicitor, Biggar, to be my Trustee and Executor, and I assign and dispose to him and to such other person or persons as I may hearafter name as trustees and executors under these presents (hereby referred to as “my trustees”) All and sundry the whole means and estate hereitable and movable real and personal wherever situated which shall belong or be owing to me at the time of my death: But these presents are granted in trust for the following purposes

(First) For payment of all my just and lawful debts, sickbed and funeral expenses and the expenses of executing the trust hereby created.

(Second) I direct my trustees at the first term of Whitsunday or Martinmae occuring six months after my death to pay the following legacies all free of legacy or other government duty and of the expense of settling the same namely

#1 to my sister Mrs. Agnes Shiels or McBride, 1391, Great Falls, Montana, USA, whom failing to her husband Thomas McBride, the sum of 200 pound sterling.

#2 to my brother John Shiels, Hazelbank, Kisby, Saskatchewan whom failing to his wife whom also failing to his children equally among them, the sum of 100 pounds sterling

#3 to my brother William Shiels, Midland, Ontario whom feeling to his wife the sum of 100 pounds sterling

#4 to my nephew Robert Shiels, Keddleston, Saskatchewan whom failing to his wife whom also failing to his children equally among them the sum of 100 pound sterling.

#5 to my sister Mrs. Margaret Shiels or Thomson, Suite C, Cadillac Winnipeg whom failing to her daughter Kathleen Thomson, the sum of 100 pounds sterling.

#6 to my niece Mrs. Isabella Shiels or Logan, 11 Jack St., Low Waters, Hamilton, whom failing to her husband whom also failing to her children equally amongst them the sum of 100 pounds sterling.

#7 to her daughter Barbara Logan whom failing to her remaining children the sum of 100 pounds sterling.

#8 to my nephew Adam Shiels, 31 May St., Hamilton whom failing to his wife whom also failing to his children equally among them the sum of 100 pounds sterling.

#9 to my brother Adam Shiels, Hamilton whom failing to his children the said Isabella Logan and Adam Shiels or their respective heirs the sum of 100 pounds sterling.

(Third) So soon as convenient after my death I direct my trustees to realise the whole of my means and estate including my property at East Mains aforesaid and its contents and after payment of the foregoing legacies and debts and expenses as aforesaid to pay and make over the clear residual of my to my sister the said Agnes Shiels or McBride.

And I confer upon my trustees all usual and necessary powers including without prejudice.

Prejudice to said generalities, power to appoint one of their own number or any other person, factor or law agent in the trust hereby created and to pay him the usual professional renumeration for his services, any law or practice to the contrary notwithstanding. And I reserve my own liferent and full power to alter or revoke these presents in whole or in part, and I revoke any testament writings examined by me at anytime heretofore and I consent to registration hereof and of any Codicil hereto for preservation. In witness whereof these presents consisting of this and the preceding page are subscribed buy me at Bigger on the 19th day of November 1929 before these witnesses Miss Kathleen Stewart Dixon and Lillian Agnes Elizabeth Godderson both clerks to Mr. Small and Ewart solicitors in Bigger.

Last Will & Testament of Barbara Shiels

Update 10th day of September 1943

I, Miss Barbara Shiels, designed in the foregoing trust settlement do hereby make the following alterations thereon

(First) I revoke and cancel items (1),(8) and (9) of purpose “second” therefore which relates to legacies to my sister Mrs. Agnes Shiels or McBride and her husband both now deceased, my nephew Adam Shiels and others and my brother Adam Shiels and others.

(Second) I provide that the legacies to my brother William and his wife and to my sister Mrs. Margaret Shiels or Thompson, (who now resides with me), and her daughter, (who is now deceased), specified under items (3) and (5) of the said purpose shall be increased to 200 pounds sterling each

(Third) I direct my trustees to dispose convey an makeover my property at East Mains, Coulter, and also the household furniture and plenishings therein with the exception aftermentioned to and equally among my nephew Robert Shiels and my nieces Mary Shiels and Agnes Shiels, all residing in Main Street, Biggar.

(Fourth) I leave and bequeathed to my niece Isabella Shiels or Logan, 11 Jack St., Low Water, Hamilton, my silver tea service and biscuit barrel

(Fifth) I direct my trustee to pay the following additional legacies to the same effect as if the same had been bequeathed under my said settlement

#1 To May Logan, daughter of the said Isabella Shiels or Logan, the sum of 100 pounds sterling

#2 To my niece the said Agnes Shiels, Biggar the sum of 100 pounds sterling

(Sixth) I revoke and cancel purpose “Third” of my said settlement and provide in place thereof as follows: So soon as convenient after my death I direct my trustees to assign convey and makeover the residual of my said means and estate to my nephew William Shiels, 10B Lochrin, Winnipeg Canada whom failing to his wife.

And exempt in so far as hereby altered I confirm my said settlement in all respects and provide that it and this codicil shall be read and construed together as forming one document. I also hereby cancel the request of 100 pounds sterling to my niece Mrs. Isabella Shiels or Logan specified under purpose “second” item six of my said settlement and substitute in place thereof her daughter Barbara Logan, to whom the said settlement is to be paid.

In witness whereof these presents are (under the declaration that the words “in witness whereof” occuring in the 37th line here of were deleted before subscription) subscribed by me at Biggar on the 10th day of September 1943 before these witnesses John Patterson Russell, treasurer Biggar and miss Ann Howieson, clerk to Smail and Ewart solicitors in Biggar.
